Privacy policy

1. Privacy at a glance

General information

The following information gives a simple overview of what happens to your personal data when you visit this website. Personal data is any data that can be used to identify you personally. Detailed information on data protection can be found in the privacy policy below.

Data collection on this website

Who is responsible for data collection on this website?

Data on this website is processed by the website operator. Their contact details can be found in the section “Controller” in this privacy policy.

How do we collect your data?

Some of your data is collected because you give it to us, for example data you write to us in an email.

Other data is collected automatically or with your consent by our IT systems when you visit the website. This is mainly technical data (e.g. web browser, operating system or time of the page request). This data is collected automatically as soon as you enter this website.

This website stores a few convenience settings (language, “Classic site”, less motion) in your browser, but sets no cookies and uses no tracking; details are in the section “Storage in the browser”.

What do we use your data for?

Part of the data is collected to ensure the website works without errors. Other data may be used to analyse your user behaviour. If contracts can be concluded or initiated via the website, the data you send is also processed for contract offers, orders or other requests.

What rights do you have regarding your data?

You have the right at any time to receive information free of charge about the origin, recipients and purpose of your stored personal data. You also have the right to request that this data be corrected or deleted. If you have given consent to data processing, you can withdraw this consent at any time for the future. You also have the right, under certain circumstances, to request that the processing of your personal data be restricted. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

You can contact us at any time about this and any other questions on data protection.

2. Hosting

We host the content of our website with the following provider:

Strato

The provider is Strato AG, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany (“Strato”). When you visit our website, Strato records various log files including your IP addresses.

For more information, see Strato’s privacy policy: https://www.strato.de/datenschutz/.

We use Strato on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website as reliably as possible. Where consent has been requested, processing is based solely on Art. 6(1)(a) GDPR and § 25(1) TDDDG (German Telecommunications Digital Services Data Protection Act), insofar as the consent covers storing cookies or accessing information on the user’s device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent can be withdrawn at any time.

The controller responsible for data processing on this website is:

Daniel Kasper
Martin-Luther-Straße 5

Phone: +49 162 9729796
Email: band@thebackwoods.de

The controller is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g. names, email addresses or similar).

Storage period

Unless a more specific storage period is stated in this privacy policy, your personal data remains with us until the purpose for processing it no longer applies. If you make a justified request for deletion or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing it (e.g. retention periods under tax or commercial law); in the latter case, the data is deleted once these reasons no longer apply.

General information on the legal basis for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR if special categories of data under Art. 9(1) GDPR are processed. If you have explicitly consented to the transfer of personal data to third countries, processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access to information on your device (e.g. via device fingerprinting), processing is additionally based on § 25(1) TDDDG. Consent can be withdrawn at any time. If your data is required to perform a contract or to take steps prior to entering into a contract, we process it on the basis of Art. 6(1)(b) GDPR. We also process your data if this is necessary to comply with a legal obligation, on the basis of Art. 6(1)(c) GDPR. Data processing may also be based on our legitimate interest under Art. 6(1)(f) GDPR. The legal basis relevant in each individual case is given in the following paragraphs of this privacy policy.

Recipients of personal data

In the course of our activities, we work with various external parties. In some cases, this requires passing personal data on to them. We only pass personal data on to external parties if this is necessary to perform a contract, if we are legally obliged to do so (e.g. passing data on to tax authorities), if we have a legitimate interest in passing it on under Art. 6(1)(f) GDPR, or if another legal basis permits it. When we use processors, we only pass on our customers’ personal data on the basis of a valid data processing agreement. In the case of joint processing, a joint controller agreement is concluded.

Withdrawal of your consent to data processing

Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the processing carried out before the withdrawal remains unaffected.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES TO ESTABLISH, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION UNDER ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING (OBJECTION UNDER ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged breach. This right is without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this is only done where technically feasible.

Information, correction and deletion

Within the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to have this data corrected or deleted. You can contact us at any time about this and any other questions on personal data.

Right to restriction of processing

You have the right to request that the processing of your personal data be restricted. You can contact us at any time to do so. The right to restriction of processing applies in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to check this. For the duration of the check, you have the right to request that the processing of your personal data be restricted.
  • If your personal data was or is being processed unlawfully, you can request restriction of processing instead of deletion.
  • If we no longer need your personal data but you need it to exercise, defend or establish legal claims, you have the right to request restriction of processing instead of deletion.
  • If you have lodged an objection under Art. 21(1) GDPR, your interests and ours must be weighed against each other. As long as it has not yet been determined whose interests prevail, you have the right to request that the processing of your personal data be restricted.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or to establish, exercise or defend legal claims, to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a member state.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries you send to us as the site operator, this site uses SSL/TLS encryption. You can recognise an encrypted connection by the browser’s address bar changing from “http://” to “https://” and by the lock symbol in your browser bar.

When SSL/TLS encryption is active, the data you send to us cannot be read by third parties.

4. Data collection on this website

Enquiries by email, phone or fax

If you contact us by email, phone or fax, your enquiry including all resulting personal data (name, enquiry) is stored and processed by us for the purpose of handling your request. We do not pass this data on without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary to take steps prior to entering into a contract. In all other cases, processing is based on our legitimate interest in effectively handling the enquiries sent to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this was requested; consent can be withdrawn at any time.

The data you send us in enquiries remains with us until you ask us to delete it, withdraw your consent to its storage or the purpose for storing it no longer applies (e.g. after your request has been dealt with). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Storage in the browser (local storage and session storage)

This website sets no cookies. So that some functions you choose yourself work as intended, it stores small values in your browser’s storage (local storage or session storage). These values contain no personal data, never leave your device and are not sent to us or to third parties:

  • lang (local storage): the language chosen with the language switch (“de” or “en”).
  • bw-room (local storage): your choice of the “Classic site” instead of the 3D room on the home page. Deleted again with “Enter the room”.
  • bw-room-settings (local storage): your graphics, motion and sound settings in the 3D room (e.g. “Less motion” or “Sound effects”), if you have changed them yourself.
  • bw-room-entered, bw-room-skip and bw-room-reloaded (session storage): whether you have already entered or skipped the 3D room in this tab, and whether it was reloaded once after a loading error.

Values in local storage remain until you delete them; values in session storage are deleted when you close the tab. You can remove all values at any time in your browser settings (clear website data). The storage is strictly necessary for the functions you have expressly requested (§ 25(2) no. 2 TDDDG) and therefore takes place without consent.

Shared coffee table in the 3D room

On the coffee table in the 3D room you can leave marks with a pen, nail, scissors and hammer. All visitors see the same table. To do this, your browser sends each mark to our server at Strato, where we store the following:

  • each mark: its coordinates on the tabletop, the tool, the time and a daily pseudonym (see below);
  • the state of the table: its number, the damage, after a collapse the position of the wreckage, and the position of the ashtray.

Your marks are visible to everyone until the table collapses and someone sets up a new one; we then delete all marks of the old table. We delete marks with illegal or offensive content as soon as we become aware of them. A note to the email address above is enough.

So that nobody destroys the table automatically, we limit how many marks one person can leave per minute and per day. For this, the server forms a shortened hash value (HMAC-SHA-256) from your IP address and a random daily key: the daily pseudonym. We do not store your IP address itself. We delete the daily key and the counters automatically as soon as the 3D room is first visited on the following day (UTC). After that, no IP address can be derived from the pseudonym. The pseudonym stays stored with your marks so that we can delete all marks of one person at once. The same method limits moving the ashtray and login attempts on our admin page.

We log faults of the table server with the time, the affected function and the error message, without your IP address or any other information about you. We delete these logs automatically after 14 days.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest lies in operating the shared table and protecting it against misuse. Nothing is stored on your device for the table. The data is kept on Strato’s server (see “Hosting”) and is not passed on to third parties.

Photo wall in the 3D room

A photo you choose at the photo wall in the 3D room is only shown in your browser. It is neither uploaded nor stored.

3D viewer in the room

While you look through the 3D viewer in the room on a smartphone or tablet, the website reads the tilt of your device to move the image slightly. iPhones and iPads ask for your permission first. The values are only used in your browser and are neither stored nor transmitted.
